Oregon Rent Increase Laws 2026: Statewide Cap, Notice and Exemptions

Oregon was the first state with statewide rent control (SB 608, 2019). The annual cap is 7% plus the West-region CPI, and since 2023 (SB 1062) never more than 10%. The Oregon Department of Administrative Services publishes the exact percentage for the following calendar year each September. Buildings whose first certificate of occupancy was issued within the last 15 years are exempt.

Can my landlord raise rent by this much?

The percentage is the 12-month average change in the West-region CPI, published by Oregon DAS in September for the next calendar year. This is information, not legal advice.

Who is exempt

  • Buildings with a first certificate of occupancy less than 15 years old
  • Subsidized affordable housing
  • Week-to-week tenancies during the first year of occupancy (no cap in the first year of a tenancy, but notice still applies)

Notice and timing

  • No rent increase in the first year of a tenancy
  • After that: 90 days' written notice, stating the amount and the effective date
  • One increase per 12-month period

If a landlord goes over the cap

  • The tenant can recover three months' rent plus actual damages (ORS 90.323(5))
