Montgomery County & Takoma Park Rent Stabilization 2026

Montgomery County's HOME Act, in effect since July 2024, limits annual rent increases to the rental-component CPI plus 3%, capped at 6%, for buildings that have been occupied for 23 years or more. Takoma Park has had its own stricter ordinance since 1981, capping increases at CPI. Elsewhere in Maryland there is no cap, though 90 days' notice is required for increases on leases of a year or more.

Covered and exempt

  • Covered: rental units in buildings 23+ years old in Montgomery County
  • Exempt: newer buildings, owner-occupied buildings of two units or fewer, licensed assisted living, units under a regulatory agreement
  • Takoma Park: nearly all rentals inside the city, with its own annual CPI figure
