Welcome to My Rental Spot.
These Terms of Service (“Terms”) govern your use of the My Rental Spot website and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
By using the Service, you affirm that you are at least 18 years old and legally capable of entering into these Terms. If you use the Service on behalf of an organization, you affirm that you have the authority to bind that organization.
My Rental Spot is a property management platform that allows property managers, landlords, and tenants to manage rental properties, applications, payments, maintenance requests, tenant screening, and related activities.
My Rental Spot does not:
Own or manage any rental properties.
Act as a landlord, broker, agent, guarantor, or insurer.
Become a party to any lease, rental agreement, or dispute between landlords, property managers, and tenants.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information, and update it when necessary. You are responsible for safeguarding your login credentials and all activities under your account.
You agree to use the Service only for lawful purposes. You will not:
Violate laws or regulations.
Upload false, fraudulent, or misleading information.
Harass, defame, or abuse others.
Interfere with or disrupt the Service.
Attempt unauthorized access to other accounts or systems.
My Rental Spot is free to use unless stated otherwise. Certain features may involve transaction fees or subscription fees.
Third-Party Payment Processing: Rent payments are processed through third-party providers (e.g., Stripe). My Rental Spot is not responsible for failed transactions, chargebacks, delays, or refund disputes.
Tenants remain responsible for rent even if payment processing fails.
Tenant background, credit, and eviction data are provided by third-party services (e.g., TransUnion).
My Rental Spot does not guarantee the accuracy, completeness, or timeliness of reports.
Landlords are solely responsible for evaluating tenant suitability.
Landlords and property managers are responsible for complying with all federal, state, and local laws, including fair housing, anti-discrimination, licensing, and rental regulations.
My Rental Spot does not review or approve listings for legal compliance.
My Rental Spot is a platform provider only. We do not control tenants and are not responsible for their actions.
Landlords and property managers remain solely responsible for the care, condition, and security of their properties.
My Rental Spot does not guarantee tenant behavior and is not liable for any property damage, theft, loss, or injury caused by tenants or guests.
All lease terms, deposits, and damages are strictly between landlords/property managers and tenants.
Landlords and property managers are strongly encouraged to maintain adequate property and liability insurance to protect their rentals against tenant-caused damages, losses, or risks.
Tenants are strongly encouraged to maintain renter’s insurance to cover personal belongings, liability, and any damage they may cause to the property.
Release and Indemnification: Landlords and property managers release and agree to hold harmless My Rental Spot, its affiliates, officers, employees, and agents from any claims related to tenant actions, including property damage or misconduct.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
My Rental Spot makes no warranties, express or implied, regarding the Service, listings, tenants, landlords, payment processors, or third-party integrations.
We do not guarantee uninterrupted availability, security, accuracy, or freedom from errors.
We are not liable for any disputes between landlords, property managers, and tenants.
Limitation of Liability: To the maximum extent permitted by law, My Rental Spot’s total liability for any claim shall not exceed the greater of:
(a) the total amount paid to My Rental Spot in the twelve (12) months before the event giving rise to liability, or
(b) one hundred dollars ($100).
This limitation applies to all claims, regardless of cause or theory of liability.
You agree to indemnify and hold harmless My Rental Spot, its affiliates, officers, employees, contractors, and agents from any claims, damages, losses, costs, or expenses (including attorney’s fees) arising out of:
Your use of the Service.
Your violation of these Terms.
Your interactions, agreements, or disputes with other users.
Any property damage, tenant issues, or legal claims connected to your use of the Service.
My Rental Spot does not provide insurance of any kind. Landlords, property managers, and tenants are solely responsible for maintaining their own insurance policies, including but not limited to:
Property insurance (for landlords/property managers).
Liability insurance (for landlords/property managers).
Renter’s insurance (for tenants).
We take reasonable measures to protect your data, but cannot guarantee absolute security. My Rental Spot is not liable for unauthorized access, hacking, or data breaches.
We may suspend or restrict access to the Service at any time for maintenance, technical issues, or security reasons. We are not responsible for lost income, lost tenants, or missed opportunities due to downtime.
To the fullest extent permitted by law:
Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.
You waive the right to participate in any class action, class arbitration, or consolidated proceeding.
These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts in [Your County], [Your State].
We may modify these Terms at any time. Material changes will be communicated through the Service or by email. Continued use of the Service constitutes acceptance of updated Terms.
Sections on disclaimers, limitations of liability, indemnification, arbitration, property damage disclaimers, and insurance disclaimers survive termination of your account.
